Terms and Conditions

General clauses:

1. Mobisium.com is a market place which connects Client to Writer. Mobisium.com charges 'platform and project management fee' which is deducted from Client payment towards Writer deliverable.
2. Writer agrees with Client on deliverable, timelines and payment terms through Mobisium.com. Client agrees with Mobisium.com payment for a deliverable. Mobisium.com agrees with selected Writer payment towards the same deliverable. The difference in payment by Client for a deliverable to Mobisium.com and payment by Mobisium.com to Writer for the same deliverable is 'platform and project management fee'. Post Client payment to Mobisium.com for a deliverable the 'platform and project management fee' is deducted from Client payment and Writer is paid as per agreed payment for the deliverable.
3. Mobisium.com will make the payment to the Writer only after receiving the payment from the Client. After the payment is made the article belongs to the Client and Writer and Mobisium.com have no right over it.
4. Mobisium.com shall have no liability to compensate the Client or Writer for any claim pressed by the Client or Writer under this Agreement except as expressly provided under this Agreement.
5. The aggregate liability of the Mobisium.com towards Client or Writer in respect of any losses, costs claimed by the Client or Writer in relation to this Agreement shall not exceed 10% of "platform and project management fee" received by Mobisium.com provided that any such claim is made not later than within 15 (fifteen) days of completion of work.
6. The aggregate liability of the Mobisium.com and its directors, proprietor, officers, employees, agents, sub-contractors in respect of any claims, losses, costs or damages arising out of or related to this Agreement shall not exceed 10 percent of project Management and platform fees received by Mobisium.com's under this Agreement or Rs. 25,000 (Rupees twenty five thousand) whichever is less. Further, any such claim(s) must be made during the engagement period of the Service Provider or within 15 days of completion of work. Mobisium.com obligation shall also be restricted only to actual and direct losses and not to any indirect, special or consequential losses. Mobisium.com shall not be subjected to any punitive or exemplary damages.
7. The Client shall be entitled to press only those claims in respect of which a loss or damage exceeds Rs. 5,000. The Client shall first make efforts to recover such losses through insurance. Any amount paid by the insurance company of the Client shall also be deducted from any claim pressed by the Client.
8. In no event shall Mobisium.com or Client or Writer, or their respective parent, subsidiary, affiliate, licensor or supplier, be liable to the other party for any special, indirect, incidental, punitive, exemplary or consequential damages or losses regarding this agreement or resulting from or in connection with a party’s performance hereunder or the use, misuse, or inability to use the platform services or other products or services hereunder, regardless of the cause of action or the theory of liability, whether in tort, contract, or otherwise, even if the liable party has been notified of the likelihood of such damages occurring. In no event shall Mobisium.com be liable for procurement costs of substitute products or services. Provided that in no event will the foregoing exclude or otherwise limit Mobisium.com’s right to seek statutory or special damages under any law or regulation.
9. Notwithstanding anything stated elsewhere the cumulative liability of ‘client’ or ‘writer’ for any liability howsoever it may arise shall not be limited to any pecuniary value.
10. Each party- Client, Writer, and Mobisium.com- agrees to indemnify, defend, and hold harmless the other party from and against any loss, cost, or damage of any kind (including reasonable outside attorneys' fees) to the extent arising out of its breach of this Agreement, and/or its negligence or willful misconduct.
11. Once the Writer receives the payment, all the work shall be the sole and exclusive property of the Client, and the Writer will not make any use of the work in any manner and not have any right of any kind whatsoever.

2. Usage Allowance:

You can use the services provided by Mobisium.com as long as you follow all the terms given below:

1. You agree not to alter any part of the website or even of any service. We expect that you will not try to alter any rules or terms, if you have problem with any terms or rules please connect with us or mail us.
2. You agree not to access the website with any other means other than the website itself. You agree that you login the website only to use it for either writing a content or getting a content written. Apart from it there are no other intentions for which you access the website.
3. You agree not to deal with any security-related issue of the website or any service that Mobisium.com provides.
4. You agree not to run any automated tool to access the website including but not limited to Spiders, Crawlers, Bots or any similar service that would send messages more than general limits to the servers used by Mobisium.com
5. You agree that you are solely responsible for (and that Mobisium.com has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Mobisium.com may suffer) of any such breach.
6. Any indirect or consequential losses which may be incurred by you. This shall include; (i) any loss of profit (whether incurred directly or indirectly); (ii) any loss of goodwill or business reputation; (iii) any loss of opportunity; or (iv) any loss of data suffered by you;
7. Any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Service;
8. Any changes which Mobisium.com may make to the Services, or for any permanent or temporary cessation in the provision of the Services (or any features within the Services)
9. Any loss of data directly or indirectly is not our liability. We shall make efforts to help you retrieve the data but we cannot be charged for the loss that you face because of the data loss..

3. Mobisium’s Rights

Mobisium.com as a service-providing platform has the right to:

1. Permanently restricting a user to use the services provided doing malpractices. If the user is caught indulging in malpractices we shall prohibit him from using the website and we make the final call on blocking the person.
2. Delete any published content on our blog or website if required by the law to do so. We can delete any content published on our website if the law demands and no party can challenge our authority in this context.
3. Discontinue their service(s) without any prior notice.
4. The Writer working in the forum are independent of Mobisium.com and are not the employees of Mobisium.com.

Rules regarding revision of the content:

1. As a part of our included features, revisions most certainly play an important part. This is touted as a security feature, allowing you to remain confident that the content you receive will meet your expectations. Our goal is always to provide you with high quality content that is error-free and serves the intended purpose. In the event that an error made it past our editors, we provide 24/7 services for immediate corrections. However, revision requests, initially, must be made within seven (7) days of notification of completion and delivery.

What Constitutes a Revision?

A covered revision is any error on our part. This includes

1. Typing errors
2. Misspellings
3. Grammatical errors
4. Criteria not included (i.e., criteria you have specified in your order, but was not included)
5. Incorrect tone or “voice” (as long as a specific voice was specified before writing commenced)
6. Any requests that were made prior to the commencement of the writing that were not completed to satisfaction (as long as any and all requests were made before writing began).

What is not covered under the Revisions Policy?

1. Initial revision requests must be made within seven (7) days of delivery with the exception of volume orders.
2. Elements that are not covered under our revisions policy include requests made after the writing has commenced and/or been submitted. We understand that certain things may be forgotten during the initial startup process, and this is why you are able to go over every detail before develop commences who will attempt to collect any additional details of your project before writing commences. Once the specifications have been agreed upon and understood, or your order has been submitted, your content is written based solely on this information. In such case it is expected that for the extra work done the payment be made.
3. Our policy is to write your content based solely on the specified or agreed-upon criteria. This means that after the writing has been submitted, dissatisfaction based on areas that were not requested is still considered good service. In these instances, we are not liable for rewrites as per our revisions policy. In addition, sometimes personal taste differ. In these cases we will attempt to accommodate you in every way, however, our development team will always choose the direction based on industry research and statistical evidence to ensure the content you receive is quality.

Our goal is for each and every Client to be 100% satisfied with their experience working with us. Our revisions policy is meant to provide a layer of security and confidence that your content is in good hands. While we cannot be held responsible for the exclusion of information/areas that were not requested/included/specified before writing began, new information can always be requested for inclusion in the next content piece/writing. We are a team and will support each other in accomplishing our professional goals.

Reservation Of Charges

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. You agree to immediately remove all links to our Web site upon such request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuing to link to our Web site, you agree to be bound to and abide by these linking terms and conditions.

Unlimited Revisions

As long as your request is covered by our revisions policy, you can request unlimited revisions. The only exception to the unlimited revisions policy is that initial requests for revisions must be made within the first 7 business days after initial notification of successful completion and delivery of content. Initial revision requests made after 7 business days will not be accepted under our revisions policy. In these instances, our responsibility under our revisions policy is considered null and void.
